中国传统社会官方将孝道作为法律文化的核心内容,辅以赈济和教化,在古代赡养纠纷解决中发挥着不可替代的主导作用;民间则以调解和慈善为主,弥补了国家力量触及不到的地方,官民互动如同相互咬合的齿轮,成为促进赡养纠纷解决的无限动力。随着中国步入老龄化社会,农村赡养纠纷频发,耄龄老人无所养、精神赡养被忽视的情况时有发生。面对新时期农村赡养纠纷的现实问题,考察传统官方和民间赡养纠纷的解决方式,分析其利弊得失和经验教训,可以对我们构建国家主导的新型老年权益保护法律体系,发挥基层自治组织的调解互助功能,形成以孝为先的良好社会氛围起到借鉴作用。
