摘要
工会是为维护职工合法权益而存在的群众组织,是工人阶级利益的代表者和维护者。针对目前我国工会维权职能不能有效发挥的现状,选取有代表性的典型案件,从思想观念、功能定位、制度设计和法律保障四个方面深度透视我国工会维权的困境,并在此基础上,建议从科学定位工会角色、改革人事和经费制度、完善法律法规、建立维权联动机制等方面积极探索工会维权的新思路,旨在通过维权机制的创新构建和谐发展的劳动关系,开辟中国工会工作的新格局。
Labor union is a people organization that aims at safeguarding the rights and benefits of employees and acts as a representative of the working class. Since Chinese labor unions cannot give full play of the safeguarding function currently, this paper, select representative typical cases, aims at analyzing the safeguarding predicament of Chinese labor union in terms of the idea and principle, function and orientation, and system design. This paper also suggests that Chinese labor unions should find new guiding principles for right-safeguarding by redefining the role of Chinese labor union scientifically, reforming labor and fund systems, perfecting laws and regulations, and setting up the mechanism. In this way, the right-safeguarding mechanism will create a harmonious development of labor relations and lead Chinese labor union to a new stage.
