摘要
职业院校学生顶岗实习,是实习生进一步获得感性认识,掌握操作技能,实现社会对人才需求的重要措施。然而由于其法律身份的不明确,导致其实习时权益频遭侵害而难以得到有效救济。研究顶岗实习生的法律身份,既有利于立法的发展,又有利于职业教育的发展和实习生实习权益的保障。本文通过顶岗实习生和劳动者等内涵的研究,明确在不同的情况下,实习生应该具备不同的法律身份。
Internship to vocational college students is an important process to acquire perceptual knowledge master skills and realize the needs of society for talents. However, their interests suffer from infringement without effec- tive relief because its legal status is not clear. Internship with legal status is not only conducive to the develop- ment of legislation, but also conducive to the development of vocational education and the protection of the rights and interests of interns . The paper makes clear that interns should have different legal status in different situa- tions through the connotation research of interns and workers.
