摘要 中超联赛转播权出售是联赛的主要经营方式之一。长期以来,中超联赛转播权均以集中打包的方式进行出售,这种方式违反了我国《反垄断法》的相关规定。采用文献资料法和数理统计法,分析中超联赛转播权垄断现状,探讨中超联赛转播在经营特征、法律性质等方面的特殊性,根据竞争性平衡理论分析中超联赛转播权反垄断豁免制度建立的必要性;认为我国应加快赛事转播权相关立法的完善,并制定合理的职业体育赛事转播权反垄断豁免制度,从而促进中超联赛转播产业的健康发展。 The sale of Super League broadcast rights is one of the main business modes for the League. For a long time, Super League broadcast rights have been sold in a centralized way which violates the relevant provisions of Anti-monopoly law. This paper adopted literature material and mathematical statistics to analyze the status quo of monopoly in broadcast rights of Super League and the specificity in the business. According to the profound research of its legal nature, there is need for us to step up related laws of broadcast rights in all sorts of games and contests as well as set up a reasonable antitrust exemption system for professional sports broadcast rights. On the basis of the theory of competitive balance,this paper further demonstrates the necessity of establishing anti-monopoly exemption system in the Super League broadcast rights so as to promote the healthy development of its broadcasting industry.
