中英网络治理的行业自律比较研究

A Comparative Study of Industry Self-regulation in Internet Governance in China and the United Kingdom

随着信息技术的高速发展,网络空间的虚拟性、匿名性、开放性和全球性等特点导致了网络世界乱象丛生,社会对互联网行业治理的要求日益增长。传统的法律和技术手段有其自身的局限性,而行业自律在网络治理中有其特有的优势。本文主要从行业自律的角度,采用比较研究的方法,通过论述中英两国网络行业自律的现状,将二者在网络治理中行业自律的主体、措施、客体以及社会环境等方面进行对比分析,从而得出对我国互联网行业自律的借鉴和思考。

With the rapid development of information technology, the virtuality, anonymity, openness, globality and other characteristics of the cyberspace have led to total chaos of the network world, and the society has a growing demand on the governance of the Internet industry. The traditional legal and technical means have their own limitations while industry self-regulation has advantages which do not exist in the other means. Therefore, from the perspective of industry self-discipline,using the comparative research method, through the discussion of the status quo of network industry self-regulation in China and the United Kingdom, this paper compares and analyzes the subject, measures, object, social environment and other aspects of industry self-regulation in network governance in both countries so as to obtain the reference and thinking for Internet industry self-regulation in China.
