信义关系是人与人之间信任与合作的基本要求,是人的利己和利他诉求的接合。正是由于信义关系所具有的较高的道德要求,因此在法律中具有不确定性。随着现代经济关系越来越强调人与人之间的合作,如何将信义关系作制度性的安排成为现代经济法制的一个基本需求。从法理学上对信义关系的分析可以厘清信义关系的重要性、基本属性,以及它在法律制定设计中的特征,以期为现代社会形成有效的合作关系提供适宜的制度空间。

The relationship of fiduciary is the basic requirement of trust and cooperation between people,and is the joint between selfish and altruistic.It is precisely because of the high moral requirements of the relationship,there is uncertainty in the law.With the increasing emphasis on the co-operation in modern economic relations,how to design the fiduciary relationship is a basic requirement for modern economic legal system.The jurisprudence analysis from perspective of fiduciary relationship can clarify the importance of fiduciary relationship and its basic attributes and characteristics,and its characteristics in the design of this law,providing a system of suitable space for the modern society to form an effective cooperation.
