唐代“涉外”婚姻制度考思

On the International Marriage System in Tang Dynasty

随着我国"一带一路"战略的深入推进和近四十年改革开放的发展,我国对外开放的程度不断加深,与世界各国的交往日益扩大,面临的涉外问题也更加频繁和复杂。涉外婚姻家庭领域是国际私法最为复杂的一个分支,《法律适用法》对涉外婚姻的法律适用做了最基本的原则性规定。通过文献研究的方法,梳理了唐代涉外婚姻制度产生的时代背景,探究其基本理论,分析其基本内容和重要特质,对其积极性和局限性作出评价,并总结了唐代涉外婚姻制度对当代的启示,为进一步完善涉外婚姻法律适用的规定提供一定的借鉴思路。

With the implementation of China＇s ＂ Belt and Road＂ strategy and the development of reform and opening-up in the past four decades,the degree of opening to the outside world has increased,and the exchanges with other countries have become more and more frequent and complicated.The field of international marriage and family is the most complicated branch of private international law.The Law of the People＇s Republic of China has established the most basic principles of the law applicable to international marriages.With the literature research method,this paper digs into the background of the international marriage system in the Tang Dynasty,explores its basic theory,analyzes its basic content and important characteristics,evaluates its positives and limitations,and summarizes the implications for contemporary times,and forms useful experience for further improvement of provisions in law applicable to international marriages.
