国内外涉法涉诉信访分离研究述评

The Study on the Separation of Complaint and Petition From Home and Abroad

当前我国正处于社会转型和各种矛盾叠加期,群众"越级上访"、"重复信访"等行为已严重影响司法权威和社会稳定。"信访不信法"能否破解,本文试图通过国外公民申诉制度的梳理以及国内理论界和地方政府涉法涉诉信访分离典型经验总结,运用比较分析法,对国内外诉访分离制度进行综述,旨在为我国涉法涉诉信访分离制度改革提供借鉴与启示。

at present, China is in a period of social transformation and various contradictions, which has severely affected judicial authority and social stability, such as ＂overvisit＂ and ＂repeated petition＂. ＂Letters not letter law＂ can crack, this paper tries to comb through the foreign citizen complaint system and domestic complaint involving lawsuit theory and local government visits separation of typical experience, using comparative analysis method, both at home and abroad visit separation system were summarized, for separation of complaint involving lawsuit system reform in our country visits to provide reference and enlightenment.
