账户保护令自由流动对商业银行的消极影响——基于欧盟《账户保护令条例》的分析

摘要 《账户保护令条例》通过加强账户保护令在欧盟各国的自由流动,在一定程度上促进跨境债务追偿,从而提升跨境贸易的发展。就条例的规定来看,严格的责任体系显然对商业银行产生了消极的影响,如营业外支出的增加、法律风险的增加等,从而进一步影响账户保护令的执行效率。因此今后在适用的过程中对条例进行不断的完善与解释显然是十分必要的。
