Establishing the Administrative Settlement Mechanism for Family Disputes

家事纠纷行政解决机制主要由行政调解、行政管理和行政保障三部分构成。当前的家事纠纷行政解决机制依然存在缺乏专门的家事纠纷行政调解机构和专业调解人员、同其他行政解决机制混同,以及忽视与诉讼程序之间的配合等问题。因此,设立专门的家事纠纷调解委员会、建立家事纠纷行政解决机制的专门程序、规定家事纠纷调解委员会支持家事诉讼并配合执行的法定义务等是构建家事纠纷行政解决机制的基本路径。

The administrative settlement mechanism of family disputes is mainly composed of administrative mediation, administrative management and administrative guarantee. The current administrative family dispute settlement mechanism still faces certain problems： there is a lack of special family dispute administrative mediation organizations and professional personnel; it is mingled with other administrative settlement mechanisms; and it neglects cooperation with the judicial proceedings Therefore, setting up special family dispute mediation committees, establishing special procedures for the family dispute administrative settlement, and defining the lawful duties of the family dispute mediation committees in supporting family litigations and assisting in law enforcement are the basic route of establishing the administrative dispute settlement mechanism.
