未成年社区服刑人员身份信息保护问题探讨

A Tentative Study on Identity Information Protection of Juvenile Termers in Community

由于未成年社区服刑人员的特殊性以及与相关刑事司法制度衔接的要求,很有必要保护未成年社区服刑人员的身份信息。但是,在目前的社区矫正实践中,对未成年社区服刑人员的身份信息保护存在一些突出问题,主要表现在:与成年社区服刑人员分开矫正存在困难,社区服务面临标签化风险,社会参与中的身份信息保护措施缺位。为了恰当解决上述问题,应当建立切合实际的专人负责模式,健全社区服务中的保护机制,完善社会参与中的保密制度。

It is very necessary to protect identity information of juvenile termers in community due to particularity of them and requirements of cohesion of criminal justice system. However,in the current community correction practice,there are some prominet problems in terms of identity information protection of juvenile termers in community. They are: it is difficult to separate them from adult termers for community correction; community service is faced with risk of tagging; some protective measures of identity information in social participation are insufficient. In order to properly solve the above mentioned problems,we shall establish specially-assigned person responsibility system,improve protective mechanism in community service and confidential system in social participation.
