中外体育用品业专利战略比较研究——以DII数据库运动鞋相关专利数据为例

A Comparative Study on Patent Strategy of China and Foreign Countries' Sports Goods Industry——Taking the Sports Shoes Patent in DII Database as an Example

以DII数据库收录的运动鞋相关专利为研究对象,从专利战略角度入手,对中外主要技术强国专利战略进行分析。研究结果显示:1)美国、德国、日本是传统技术市场中心,完善的知识产权保护体系,培养了企业良好技术创新和专利保护意识,并形成核心企业集聚效应。2)凭借高质量的核心技术,利用同族专利申请逐步扩展、探索和垄断国际技术市场已成为国外大型跨国企业的重要专利战略,而国内多数企业仍滞留于国内市场。3)从耐克公司核心专利分布来看,人性化智能运动监测系统、新材料的运用、符合运动人体科学原理结构设计等成为其新一代技术研发的重心。4)耐克公司逐步形成具有"核心-边缘"合作网络特征的稳固高效的科研团队,使公司的技术始终处于连续升级和不断创新可持续发展的状态中。面对与国外企业在核心技术上的差距,我国知识产权制度体系还需进一步完善,提升企业技术创新和专利保护意识,认真贯彻和领悟政府提出的"供给侧结构性改革"重要方针的核心理念,稳步实现产业转型发展。

From the perspective of patent strategy,and taking the sports shoes related patents included in DII database as the research object. this paper analyzes the patent strategy of Chinese and foreign key technologies. The results show that 1） the United States,Germany,Japan are the traditional center of technology market,perfect IPR protection system foster a good corporate technological innovation and patent protection consciousness,and generate the core enterprise agglomeration effect. 2） the use of the family patent application with the core technology to explore the international monopoly technology market has become an important patent strategy of large foreign multinational companies,and most domestic enterprises are still stuck in the domestic market. 3） from the core patent distribution of Nike,the intelligent motion monitoring system,the use of new materials,and in line with the principles of human science and technology to design the structure has become a new technology research point. 4） Nike has gradually formed a stable and efficient research team with the characteristics of the ＂core edge＂ network,so that the company＇s technology is always in a state of continuous upgrading and continuous innovation and sustainable development. Faced with the gap between foreign and Chinese enterprises in the core technology,Chinese system of intellectual property needs to be further improved,to promote enterprise technological innovation and patent protection consciousness,conscientiously study the important policy of ＂supply side structural reform＂stated by the government,to achieve a steady industrial transformation development.
