居住证制度下随迁子女受教育权实现的法学分析——以权利的存在形态为视角 被引量:2

摘要 新型城镇化要求实现人的城镇化,居住证制度因势而生,为随迁子女受教育权平等实现提供了重要契机。随迁子女受教育权实现,需要以权利的三种存在形态为视角,厘清其权利实现的三大挑战:权利法定化的技术壁垒、责任主体权利供给匮乏和权利实现的非均衡状态。只有破除权利主体身份障碍、完善权利保障机制,动态监测权利供给状况、合理平衡权利需求,强化权利供给能力、落实教育供给侧改革,推动补偿教育立法、回归教育公平本质,才能真正推动随迁子女受教育权平等实现。 The demands of realizing urbanization of people under new-type urbanization and the implementation of residence permit policy provide an important opportunity for the migrant children's equal realization of the right to education.The realization of the children's right to education needs to clarify the three challenges from the three forms of the existence of the right,which includes technical barriers to legalization of rights,lack of the supply of right and the non-balanced state of realization of right.Only by breaking the barriers of the main body of the rights,improving the rights protection mechanism,monitoring of the supply of rights and balancing rights requirements reasonably,strengthening the power supply capacity,implementing education supply side reform,promoting the compensation legislation of education to return to the essence of fair education,can we truly promote the equal realization of the migrant children's right to education.
