论经济民主与经济法的关系及实现的经济法进路

On the Interaction Economic Democracy and Economic Law and Its Implementation Path of Economic Law

强化经济民主保障是推进供给侧结构性改革,创新政府治理经济方式的重要途径。经济民主与经济法具有内在的互动互促关系。经济民主是经济法的基本理念和目标,对经济法的发展与完善起着重要指引作用;而经济法又是经济民主实现的基本法律保障。为保障和促进经济民主的实现,我国应完善宪法基本经济制度,有效界定政府干预市场边界,完善市场秩序规制制度和宏观调控法律制度,构建经济法社会整体利益代表和实施机制。

It is an interactive and cooperative mechanism for economic democracy and economic law. Economic democracy has aguiding role in the development and improvement of the economic law, and economic law is an important legal protection of economicdemocracy. China should improve the basic economic system in the constitution, define reasonably to the legal boundaries of govern鄄ment intervene in the market, improve the market regulation law systems and the macro-control law systems and build the representa鄄tive and enforcement mechanisms of the overall interests of society in order to give full play of protection function and the promotion ofeconomic law to economic democracy.摇 摇
