Research on the Traditional Yamen Legal Culture of Henan Province

传统衙署和现代法律文化能够产生交集,源于中国历史上长期以来深刻的政治文化传统,即刑名司法是地方行政的应有之义,由此赋予地方各级主官及其衙署多种复合法律功能,几乎涵括了当代中国司法系统中公安局、法院、检察院以及司法局的职能,并充分体现在衙署建筑中。河南衙署建筑蕴含了中国传统司法之亲民、教化和息讼的三大基本价值追求,衙署建筑体现出中国古代社会礼制传统,如面南背北、居中而治、前朝后寝、左文右武等。

The intersection between Chinese ancient Yashu（ government offices in ancient China） and the modern concept of legal culture,is rooted in the profound political tradition that judicial affairs are included in the local administration in ancient China. This,therefore,endows all levels of local officials and their official buildings with multiply judicial functions,which nearly contain all the basic functions of the bureau of pubic security,court of justice,public prosecutor＇ s office and department of justice of contemporary China,and are mainly reflected in Yashu buildings. Henan Yashu buildings reflect the three basic value pursuits of Chinese traditional judicial affairs,namely being kind to the masses,moralizing the common people and trying to avoid lawsuits. Henan Yashu buildings,meanwhile,embody the social rites traditions of ancient China,for example,miannanbeibei（ facing the south）,Juzhongerzhi（ main buildings standing on the central line）,qianchaohouqin（ official area in the front part while living area in the back part）,and zuowenyouwu（ the pen on the left and the sword on the right）.
