体育赛事中的知识产权问题研究

理清体育赛事及其相关概念,基于体育赛事可以产生众多的著作权,分析体育赛事单项赛事与著作权、体育赛事节目与著作权、体育赛事与录音录像制作者权、体育赛事与广播组织权。我国的著作权法和商标法中指出有大量的与体育赛事相关的侵权行为。这些问题可以通过完善体育赛事知识产权保护的路径来解决,包括:1)强化知识产权基础理论研究;2)完善知识产权相关立法;3)重视知识产权行政保护;4)加强知识产权司法保护;5)强化知识产权宣传力度。

To clarify the sports events and its related concepts, sports events can produce numerous copyright based on the analysis of individual events and works of sports right, sports programs and copyright, audio and video recordings of sports events and sports events and rights, and the rights of broadcasting organization.China＇s copyright law and trademark law stipulates a large number of violations related to sports events. These problems can be solved by the perfection path of sports intellectual property protection, including 1） to strengthen the study on the theory of intellectual property foundation; 2） to improve the relevant legislation of intellectual property rights; 3） to attach importance to the administrative protection of intellectual property rights; 4） to strengthen the judicial protection of intellectual property rights; and 5） to strengthen intellectual property publicity.
