非正式制度因素影响下的利益冲突治理制度变迁分析 被引量:4

摘要 非正式制度是影响公职人员利益冲突治理制度变迁不可忽略的重要内生动力。作为制度内核的非正式制度价值观念、文化传统、伦理道德和习惯习俗等关键因素,影响和决定着现行颁布实施的利益冲突治理正式制度能否得到内在价值观念认同、政治生态文化支持、伦理道德自觉接受以及廉洁行为习惯遵循等。因此,推进非正式制度影响下公职人员利益冲突治理制度变迁,既要培育各类积极的非正式制度因素,以充分发挥其激励引导现行制度变革创新的诱致性制度变迁功能;还要通过渐进式变迁方式,实现非正式制度增量与正式制度存量的整体协调推进;最终通过非正式制度与正式制度有机结合、协调变迁与匹配支持,形成相容耦合推进利益冲突治理进程的制度约束合力,提升公职人员利益冲突治理实效。 An informal system, as an important and inevitable endogenous motive, affects the institutional changes of the govemance of public servants' conflicts of interest. As the key factors in the core of system, the values, cultural traditions, ethics as well as habits and customs affect and decide whether the formal system of governance of conflicts of interest that is issued and enforced at present will obtain the identification of core ideas of value, the support of political ecological culture, the conscious acceptance of ethics and the adherence to integrity. Therefore, a series of measures should be taken to promot the institutional changes of governance of conflicts of interest among the public servants under the influence of informal system. First, all types of active factors of informal system are supposed to be cultivated to fully fulfil their functions in the inductive change of institution to motivate and guide the innovative changes of current systems. Then the gradual changing mode is suggested to be adopted to achieve the coordinating promotion of the increment of formal system and stock of informal one. Final- ly, a compatible coupling is formed through organic integration, coordinating changes and matching support between the informal institution and the formal one, enhancing the controlling power of the governance process of conflicts of interest while promoting the practical effects of governance of conflicts of interest among the public servants.
