医患冲突治理:法治的缺席及其矫治——一个基于身份冲突的解释框架

Why is Rule of Law Absent from Hospital-Patient Conflicts Governance?——An Analysis Framework of Identity Conflict

由医患关系所引发的社会冲突长期存在,在患方博弈筹码的反复权衡和医方压力型体制的约束下,法治在冲突治理过程中基本处于缺席状态。医患双方拒绝法治的理由不尽相同,但二者同时都具有双重角色,由此决定了各自的行为取向和价值偏好。因此,治理医患冲突的现实对策是回归医患双方的本体身份,通过改变医方的官民二重性身份、以当事人身份替代患方的不当身份认同等途径,在弘扬法治信仰的路径上矫治因法治缺席带来的治理失灵问题。

Hospital--patient conflicts have been existing for a long time in contemporary Chi- na. Under the intense activities from both the patient and hospital, game weights and pressure system exclude rule of law in the process of conflict governance. Neither the hospital nov the pa- tients accept law as an approach, the corresponding identities which determine their value and be- havior preference play a key role. By means of law culture, the countermeasures are constructed on the base of their legal identities.
