法律翻译中的“译者中心”的理念与实践探索

Studies on the Theory and Practice of“Translator-centeredness”in Legal Translation

文章从生态翻译学中"翻译适应选择论"来解读译者的角色,提出"译者中心"应当是法律翻译过程中的核心理念。文章分析了译者在法律翻译实践过程中对原文"适应"与译文"选择"时所应注意的问题,结合法律英语的特点,提出了法律翻译过程是译者作为中心,以"多维度适应"为衡量翻译效果的原则,通过在法律翻译生态中不断的适应性选择,传递并实现原文法律文本的交际意图,做出译语法律生态下最适合的译本。

On the theoretical basis of translations as adaptation and selection, the theory and practice of translators- centeredness in the course of legal translation are discussed in this paper from the perspective of eco-translatology. The leading functions played by translator in the whole process legal translation are deemed to be one of the most significant elements. By introducing the features of legal English, analyzing the responsibilities of translators, and the issues that arise in the process of translators＇ selection, it is concluded that legal translation process should be translator-oriented and conducted with multi- dimensional adaptation principles, and that effective adaptation and selection in translation ecology are pursued in order to get the optimum translation.
