摘要
我国第三人撤销之诉确立之时,未融合与相关制度之间的关系,导致立法后该诉的运行环境错综复杂。理论上来看,与第三人制度的脱节,与案外人再审之诉的重复,导致第三人撤销之诉的运行举步维艰。2013年至2016年的诸多裁判文书统计数据证实外部运行环境的问题妨碍了第三人撤销之诉作用的发挥。有必要以制度融合为导向,完善第三人制度,尤其应设置诉讼告知制度,实现第三人撤销之诉与第三人制度的功能衔接;取消案外人再审之诉,避免重复救济,最终优化外部运行环境。
As for legislation of the third party revocation lawsuit in China,because of contradictions with the relevant systems,the environment the third party revocation lawsuit operates is intricate. In theory,because that the third party revocation lawsuit disconnect the third party system and repeat the function of the third party retrial lawsuit,it operates difficultly. The statistics of referee instruments from 2013 to 2016 show that the external environment has hindered the operation of the third party revocation lawsuit. It is necessary to improve the third party system,especially set up the litigation notification system to connect the third party revocation lawsuit and the third party system. And It is necessary to abolish the third party retrial lawsuit to avoid repetitive relief.
