监察委员会的设立与人大制度的完善及宪法修改

The Establishment of Supervision Committee and Improvements of NPC System and Constitution

监察委员会的设立涉及人民代表大会制度内部关系的调整,是我国政治体制改革的重大步骤,需要宪法做出重大的修改,完善人民代表大会制度。建议增加监察委员会为人民代表大会制度的主体,明确规定人大与监察委员会的关系,同时还应将国家主席、中央军委明确为人民代表大会制度的主体,理顺人大与国家主席的关系、人大与中央军委的关系。除明确规定国家监察机关由同级人民代表大会产生,对它负责,受它监督之外,还需在宪法总纲中对所有有关政体条文进行调整和修改。

The establishment of supervision committee concerning about the interior adjustment of NPC system,is a crucial step of China's political reform. It needs a great improvement of the Constitution and NPC system. This article suggests authorizing the supervision committee as a principal part of the NPC system,and clarifying its relationship with the NPC. Also,the President and Central Military Commission should be confirmed as subjects of the NPC system,and their relationship with each other should be clearly defined. In addition to the clear stipulation that the supervision committee is derived from,accountable to,and supervised by the people's congress of the same level,there should be adjustments and amendments of articles relating to China's regime in the general principles of the Constitution.
