行业协会价格垄断问题探析

行业协会在运用行业自治权约束会员企业的活动、使企业遵守竞争规则、对维护市场秩序和促进经济发展等方面起到了重要作用,这些行为的结果在客观上与反垄断法维护自由、公平竞争的目的是不谋而合的。同时,行业协会为了实现会员企业利益的最大化,可能会通过签订价格同盟协议等方式操纵市场继而形成价格垄断。从行业协会及其价格垄断行为的界定入手,分析了行业协会价格垄断行为的产生原因,提出了解决行业协会价格垄断的相关策略。

The trade association takes advantage of the industry autonomy right to restrict behaviors of member enterprises, make them comply with the competition rules, and play an important role in maintaining the market order and promoting economic development. The results coincide with the objective of anti monopoly in maintaining free and fair competition. At the same time, in order to maximize the interests of member enterprises, the trade association may manipulate the market and form a monopoly price by signing the price alliance agreement. From the definition of the trade association and its price monopoly, the paper makes an analysis of the causes of the trade association＇s price monopoly, and puts forward some strategies to solve the problem.
