党内法规清理的反思与法治化重建

党内法规体系不仅是党内治理法治化的制度载体,也是全面从严治党的根本依据。党内治理的法治化转型、建设党内法规体系的客观实际,以及清理机制的制度效能,都决定了构建完备的党内法规体系必须以科学的党内法规清理机制为前提。党内法规清理目前存在着制度供给不足、实质内容粗糙、具体实践疏漏及民主参与度低等问题,应从明确基本原则、充实制度供给、完善实质内容、强化民主参与等方面进行法治化构建,使其从无序性、运动化的清理方式,走向刚性、统一的党内法规清理长效机制。

The inner - party legal system is not only the institutional carrier of the rule of law within the party, but also the fun- damental basis for the strict rule of the party. The transformation to rule by law in the inner - party governance, the objective re- ality of the construction of the inner - party legal system, and the system efficiency of the clean - up mechanism have determined that the construction of a complete inner - party legal system must be based on a scientific inner - party regulatory clean - up mechanism. There are some problems with the present clean -up system, such as insufficient system supply, rough substantial content, lack of concrete practice and low degree of democratic participation. We should construct the rule of law from the as- pects of clarifying the basic principles, enriching the system supply, perfecting the substantive content and strengthening the democratic participation. Only in this way, can the clean - up change frown the disordered, movement style at present to a rigid, unified long -term mechanism.
