外观设计专利保护的行政执法刍议

DISCUSSION ON ADMINISTRATIVE ENFORCEMENT OF PATENT PROTECTION FOR DESIGN

文章着眼于近年来专利权侵权案件中占主要比例的外观设计专利侵权,通过对外观设计专利保护行政执法进行分析,总结归纳在外观设计专利保护行政执法过程存在的问题,提出通过建立统一行政执法标准、完善审查制度、构建区域化保护模式等方式,以充分保障外观设计专利权,提高专利行政执法的水平。

This paper focuses on the infringement of patent infringement of design in the main proportion of patent infringement cases in recent years,this article through to the design administration law enforcement analysis. Summarize the problems existing in the process of administrative enforcement of patent for design. It puts forward that the patent right of design can be fully guaranteed and the level of administrative enforcement will be improved through the establishment of uniform administrative law enforcement standards,the improvement of the review system and the construction of a regional protection model.
