论版式设计的法律保护

图书期刊等出版刊物的版式设计作品属于出版者的创造性智力劳动成果,因此,我国著作权法赋予了图书期刊出版者——版式设计权。但从实践角度来看,现有法律的规定,对出版者的版式设计权的保护重视程度不够高,并且存在一定的缺陷。随着传统图书期刊出版业竞争的愈演愈烈以及互联网新型图书期刊的大量涌现,出版者的版式设计权的保障制度应当得到更高的重视和不断的完善。

Books,journals and other publications of the format design works belongs to the publisher＇s creative intelligence work achievement,therefore,China＇s copyright law gives the book periodical publisher-format design.But from a practical point of view,the existing legal provisions,to the attention of the publisher of the format design rights protection degree is not high,and there are some defects.As the traditional book journal publishing industry competition intensified and the Internet new book journal,publisher of the format design rights protection system should be higher recognition and continuously perfect.
