知识产权审判中的技术调查官制度刍议

A Discussion of Technical Investigation Officer System in IP Litigations

为了顺应知识产权审判专门化的趋势,提升裁判主体把握技术事实的能力,2014年底我国借鉴域外经验引入了技术调查官制度,使专业技术人员以司法辅助人员身份参与知识产权技术类案件的审理,旨在增强技术事实查明的科学性、高效性和公正性,最终实现协助法官理解技术概念、破解技术疑点、化解技术争议的目的。这项制度经过两年多的实践,一方面发挥了提升裁判品质和审理效率的作用,另一方面暴露了损害当事人正当程序利益的问题,给进一步完善留下了充分的讨论空间。

In order to comply with the tendency of specialization in the field of an IP litigation and improve judges’ability to identify technical facts,the technical investigation officer system has been introduced into China at the end of 2014.The introduction of this system is aimed at improving the objectivity,neutrality,and impartiality in telling a technical fact in an IP litigation,through which technical investigation officers can assist judges to understand technical concepts,resolve technical doubtful points,and get technical disputes settled.With two years’observation,this system has be found,on the one hand,playing an effective role in improving the quality of judgment and trial efficiency;On the other hand,it may also interfere the proper legal process of the persons involved in some aspects.It is necessary to improve its defects and make it better.
