深度链接行为本质是信息网络传播行为。当通过前置法无法对深度链接行为进行有效规制时,刑法的介入具有必要性,但刑法在介入深度链接行为时理应保持谦抑。在入罪路径上,深度链接行为适用侵犯著作权罪存在障碍,因此,不得不从刑事立法的层面考虑,通过对《著作权法》的修改以及对侵犯著作权罪进行立法拟制加以改良。
