基层检察院业务部门改革问题研究

Research on the reform of business sectors in grass-roots procuratorate

我国基层检察院在业务部门设置上存在标准不统一,以及部分职能冲突等问题。在司法改革过程中,不少地方检察机关正在进行"大部制"改革,但多数还只是机械地机构合并或者分立,在改革措施上不尽合理,没有起到应有的效果。应当在理清检察职能的基础上,设置统一标准,重新定位部门角色和职能分配;并在改革的基础上,将业务部门整合为公诉部、司法审查部、民事行政检察部、刑事诉讼监督部和刑事执行检察部。

There are some problems on the setting of business sectors in the grass-roots procuratorates in China,such as the inconsistent standards and conflicts of some functions. In the process of judicial reform,the reform of＂big departments＂is being carried out in quite a few places. However,many of them are still merged or divided only by mechanical means. They are not rational in their reform measures and have not achieved the desired results. They should set unified standards and reposition the roles of departments and the division of functions on the basis of clarifying procuratorial functions,and integrate the business sectors into the public prosecution department,the judicial review department,the civil administrative prosecution department,the criminal procedure supervision department and the criminal enforcement prosecution department on the basis of the reform.
