对我国社会法理论研究的内容进行横向梳理,按照必然性研究、实然性研究、应然性研究进行分类。在必然性研究中,社会法的出现是历史的必然,学者们已经取得了基本的共识;在实然性研究中,学者们讨论的语境不同,导致社会法的内涵与外延难以界定,难以形成理论体系建构的共识,但这种理论争鸣也体现了学术研究的繁荣;在应然性研究中,社会法的价值取向渐趋明朗,只是在表述上各有侧重。社会法是最接近新时代中国特色社会主义目标的法。社会法的研究应立足中国土壤,坚持马克思主义法学方向。

The paper sorts the contents of the theoretical research on Social Law in China and classifies it according to the study of the necessity？the study of the factuality and the study of the probability. In the study of thenecessity？the appearance of Social Law is an inevitable historical issue？on which scholars have obtained basicconsensus？in the study of the factuality？the different contexts discussed by scholars lead to the difficulty of defining the connotation and extension of Social Law？on which the theoretical consensus is difficult to be obtained？but this theoretical debate also reflects the prosperity of academic research？in the study of the probability？the value orientation of Social Law is becoming clearer？with different emphasis on expressions. Social Law is the lawclosest to the goal of socialism with Chinese characteristics in the new era. The study of Social Law should bebased on the soil of China and adhere to the direction of Marxist jurisprudence.
