赡养费纠纷的解决路径研究

我国老龄化现象愈加严重,涉及老年人赡养的法律制度却相对滞后。司法实践中如何及时化解赡养纠纷,落实服判息诉等问题,成为处理家事矛盾的关键。赡养费纠纷案件具有鲜明的道德性和伦理性,法院在判决时会充分考量当事人对司法裁判的可接受性,求得个案的实质公正性和妥当性。围绕赡养费纠纷案件的特殊性,以赡养费的确定标准、赡养人之间法律关系、诉讼时效等问题为切入点,结合家事审判实务中的疑难问题,提出解决赡养纠纷的有效路径,以助力于构建符合我国国情、臻于完善的赡养法律制度。

As the phenomenon of aging in China becomes more and more serious,the legislation on supporting the elderly is lagging behind. How to solve the maintenance disputes in judicial practice in time and to implement the principle of complying w ith the judgement and putting dow n the prosecution becomes the key to handle the contradictions among the family members. The case of alimony dispute has a clear moral and ethical nature. When judging,the court w ill fully consider the parties＇ acceptability of judicial adjudication and obtain the substantive fairness and validity of the case. Focusing on the peculiarity of alimony dispute cases,take setting the standard of alimony,the legal relationship betw een aliens and the limitation of law suit as the starting point,the paper put forw ard the effective w ays of settling the maintenance disputes by combining the difficult problems in the practice of family justice,to build a perfect legal maintenance system that is in line w ith the national conditions of China.
