论党内法规的“法”属性

党内法规属性定位是党内法规在中国特色社会主义法治体系中发挥作用的前提,也是衔接协调好党内法规和国家法律的关键。党内法规不是国家法律,但效力不亚于国家法律,对国家法律具有溢出效应。党内法规是法,具有"法"的属性,符合软法的一些特性,但其自成体系,应以权力限制和权利保障原则加强制度建设,并衔接协调好国家法律,提高党内法规执行力。

The attribute orientation of the inner - party laws and regulations is the prerequisite for the party＇s laws and regulations to play a role in the socialist law system with Chinese characteristics and the key to the co- ordination of the partyg internal laws and national laws. Party law is not a national law, but the effectiveness is no less than the national one, which has a spillover effect. The law of the party is a law, which means it owns the attribute of ＂law＂ and it is in line with some of the characteristics of soft law, but it has self - contained sys- tem. We should strengthen the system construction on the base of power limit and rights protection principles, and coordinate with national laws to improve the implementation of party regulations force.
