作为法官法,普通法的优势在于能够从具体案件中发展出更具体因而也更公平的规则;作为救济之法,普通法为民众的创新精神保留了空间,而且塑造了负责任、有担当的公民;借助于判例的形式,普通法保持了对于各种规范渊源的开放性和对不同文化传统的适应性以及自身发展的连续性。普通法的这三个特点,从内在机制上解释了为什么它能够更好地维持国家稳定和促进社会经济的发展。

As judge -made law, common law can make from cases rules which are more concrete than statute provisions; as a result, these rules can be more fair to litigants. As the law of remedy, common law keeps enough space for people＇ s innovation and shape them as citizens with responsibility. As case law, common law keeps open to all sorts of different sources of rules and adaptable to different culture and tradition, and the continuity of its own development. These three characters explain why common law can do better in keeping the peace of society and the development of economic.
