劳动关系集体化转型路径与演变机制研究:比较制度分析视角 被引量:3

摘要 我国沿海部分地区的劳资关系正经历从个体到集体的转型过程,文章在比较制度分析的框架下,对其集体劳动关系转型的路径及演变进行了讨论:集体劳动关系转型建立在劳资双方参与人认知变化和外界环境与制度变迁的基础上,外部诱发性环境变化和相关域内部认知的累积性影响是集体劳动关系转型的先决条件,学习和模仿等则是实现集体劳动关系转型的关键路径,传声机制与非正式工人团体则充当了动员中介,为集体劳动关系转型提供了体制外的组织支撑,而政府作为外在的博弈规则,决定了劳动关系集体化形成与演进的制度环境,劳动关系集体化转型有赖于政府角色的转变。推动劳动关系集体化转型需要进一步调整政府介入方式、推动工会职业化改革、完善产业行动治理机制、支持社会组织发展等。 Industrial relations in coastal areas of China has undergoing a transformation from individual to collective in a certain period. This article discusses the path and evolution of the collective transformation of industrial relations in the framework of Comparative Institutional Analysis: the collective transformation of industrial relations is based on the cognitive change of both employee and employer participants, as while the external environment and the institutional change, the cumulative influence of the external induced environment and the internal cognition of the relevant participants is the prerequisite for the collective transformation of industrial relations. Learning and imitation are the main methods to realize the collective transformation of industrial relations, The acoustic mechanism and the informal workers' groups also act as mobilization intermediaries, providing external institutional support for the collective transformation of industrial relations. The government also play an important role in the transformation empirically in the construction of labor relation regulation We should promote the collective transformation of industrial relations by adjusting the way of government intervention, promoting the professional reform of trade union, improving the industrial action governance mechanism and encouraging the development of social organizations, etc.
