防控数字资源许可使用法律风险的内部技术机制研究

Study on Internal Technical Mechanism for Preventing and Controling the Licensing of Digital Resources Legal Risk

在数字资源许可使用法律关系中,数据库商对图书馆和最终用户的使用行为有严格限制,由于三者之间存在信息不对称,读者的违规使用行为可能导致图书馆面临法律风险。西安交通大学图书馆在合理规避数字资源使用限制的前提下利用自动化、主动式的内部控制机制,基于使用统计和流量控制的自动化控制系统,在违规使用发生前适度提醒读者,达到了有效预警及阻断风险行为发生的效果;同时通过网关负载平衡为不同类型的读者提供差异化的数字资源访问,进而提高了数字资源管理与服务的效率和水平,以保障数字资源合理、安全、高效利用,规避其中的法律风险。

In the legal relationship of the licensing of digital resources, the resource provider sets strict restrictions on the use of libraries and users. Due to the information asymmetry among the three, reader＇s violation use behavior may lead to legal risk faced by libraries. Xi＇an Jiaotong University Library circumvents the restrictions reasonably on digital resources use, reminds readers before violation use occurs, warns and blocks the occurrence of risk behavior by automatic internal control mechanism and automatic control system which based on using statistical and flow control. Differentiated access is provided for users through network load balancing to improve efficiency and level of digital resources management and service, so as to ensure the rational, safe and efficient use of digital resources, and avoid legal risks.
