克隆人技术发展具有广阔的运用前景,可被用于"生育"孩子、治疗疾病和怀念故人。但克隆人技术的发展给人类带来便利的同时,对宪法上的生命价值、人的尊严、社会和家庭秩序构成强烈冲击,需要积极予以立法应对。在克隆人技术的立法过程中,应当以宪法上的生命与人的尊严为价值基础,遵循宪法上的法律保留原则、民主参与原则、法律明确性原则和比例原则的要求,在相互冲突的宪法价值中寻求必要的平衡。展望未来,我国应当以生命和人的尊严为价值基础对克隆人技术立法进行合宪性调整。

The development of Human Clone Technology has broad application prospects which can be used for childbearing ＂ children, treatment of disease and miss the dead relatives. Human Clone Technology development can bring convenience to human, but at the same time, it also brings a strong impact on the constitutional value of life, human dignity, social and family order that need legislative response. In the process of human clone technology legislation, we should regard constitutional life and human dignity as the value base, follow the constitutional princi- ple of Law Reservation, democratic participation, clear statement and proportionality, and proper balance the conflicting values. Looking ahead, our country should take the value of life and human dignity as the foundation and carry on the constitutional adjustment to the human clone technology legislation.
