浅谈专利申请中流程事务的应对策略

Analysis on the Coping Strategies of Procedural Matters in Patent Applications

本文对专利申请的流程事务进行归纳梳理,介绍了申请前、审查中、授权后三个阶段中常见流程事务的主要应对策略,结合专利法、专利法实施细则、专利审查指南、国家知识产权局规定、官方网站介绍等权威材料,给出专利电子申请、专利代理委托、专利检索、专利费用减缴、请求书填写、著录项目变更、答复期限、缴费方式、发明优先审查、复审、行政复议、行政诉讼、专利转让、专利许可等方面流程事务处理的建议。

This paper analyses the procedural matters of the patent applications, introduces the main solutions to the frequently asked questions occurring in the different stages of the patent applications, i.e. before patent applying, in patent examining and after patent right granting. This paper sums up the official regulations provided by the State Intellectual Property Office（SIPO）, such as, the Patent Law, Implementing Regulations of the Patent Law, Guidelines for Patent Examination, the Ordinance of SIPO, offers the suggestions on the procedural matters for the following aspects： patent electronic application, appointment of patent agency, patent searching, reduction and postponement of payment, request filling, making changes in bibliographic data, time limit on response, methods of payment and settlement, priority examination of invention patent applications, reexamination, reconsideration of administrative measures, administrative litigation, assignment of patent right and patent licensing.
