公路隧道安全通行法律问题研究

当前，我国公路隧道交通事故频发。本文参考国内外2000多起公路隧道交通事故分析，总结公路隧道交通事故发生规律；梳理美国、日本等15个国家和地区隧道通行的相关法律规定，提炼国（境）外关于隧道安全通行的经验做法；并结合我国实际情况和事故发生规律，对我国公路隧道安全通行相关法律规范进行评析，从立法、执法、守法等多方面提出意见建议，积极探索隧道通行安全的依法治理、源头治理和综合治理之道。

Currently, traffic accidents in road tunnels happen frequently in China. By referring to the analysis results of more than 2000 cases of road tunnel traffic accidents happened at home and abroad, the paper summarized the occurrence rules of road tunnel traffic accidents and studied relevant laws and regulations regarding the road tunnel traffic safety in 15 countries and regions, including the United States and Japan. The paper also extracted successful experiences on road tunnels traffic safety from other countries and regions. Combining all these information with China＇s actual situation and the occurrence rules of this kind of traffic accidents, the paper analyzed Chinese laws and regulations relating to tunnel traffic safety, proposed some suggestions, from the aspects of legislation, law enforcement and publicity, on how to effectively strengthen the tunnel traffic safety management.
