绘文字是一种基于代码产生的具有固定图片尺寸的表情符号,它具有独创性表达的部分应当受到著作权法的保护。因其在交流过程中起到补充情绪的作用,绘文字的著作权保护在作品类型中存在实用艺术作品和美术作品的选择,但将绘文字归类到美术作品更符合其发展趋势。在许可方面,供应商通过规制编码和规制图片两种途径来制定绘文字的许可规则,主要包括知识许可协议、分类型许可、Apache许可证。

Abstract： Emoji, a kind of the emotion icons, is based on the code and presented as a fixed-size image on the Internet. Emoji＇s original expression should be protected by copyright law. Because emoji has a function of expressing feelings in network communication, it can be categorized as works of applied art or fine art. The suppliers formulate emoji＇s license by ruling the code or the image, such as Creative Commons license, categorical license and Apache license.
