Comparative Studies upon Negative Investment Lists of Members of Trans-Pacific Partnership Agreement

负面清单的外资管理模式已越来越成为国际投资规则发展的新趋势。中国也将在中美双边投资协定中首次应用负面清单模式。跨太平洋伙伴关系协定(TPP)在投资与跨境服务贸易领域确立了超越WTO纪律的高标准,TPP包含12个经济发展水平各异、经济发展模式多元的发达及发展中国家,通过对这些国家投资负面清单的综合分析必将为我国的负面清单国际实践增加经验。尽管TPP目前并未正式开始实施,但并不排除其在未来会重新启动的可能性。本文综合分析了TPP投资部分的内容及12个成员国家附件Ⅰ、附件Ⅱ的负面清单的内容,分类总结不同经济发展水平的国家的负面清单的特点,为我国应对中美BIT谈判以及其他负面清单谈判提出几点经验借鉴。

The trend of negative investment List is getting increasingly popular. And China will take this form for the first time in the Sino-American Bilateral Investment Treatment. Trans-Pacific Partnership Agreement has established high standards in investment sphere, which have exceeded WTO. 12 members of TPP which includes both developing countries and developed countries vary in economic development level and model, so conducting a comprehensive analysis upon negative lists of these countries will definitely do good to our negative list. Although the TPP has not come into effect due to America, one day it may restart. This paper analyzes the investment chapter and negative lists of 12 members, and analyzes respectively characteristics of lists of developed members and developing members, and lastly brings several suggestions for China.
