执业风险基金制度是特殊普通合伙企业的一种执业防范措施,其目的是保护债权人的利益,提高律师事务所抵御风险的能力,在合伙人和债权人之间找到利益平衡点。但是执业风险基金在法律上还没有更为细化的标准,在实践中操作困难。因此,正确认识和分析这些缺陷,提出完善执业风险基金制度的方法,对促进律师事务所的发展和保护债权人的利益有着重要意义。

The system of the professional risk fund is a preventive measure for the special general partnership. The purpose is to protect the law firms from risks so that the interest balance point between the partner and creditor may be found out. However,there are still nor detailed standards for the professional risk fund legally,which lead to practical difficulty. Therefore,it is argued to know and analyze the defects correctly and propose methods for improvement. It is of great importance to promote the development of the law firm and protect the creditor's lawful right.
