腐败是公权力滥用谋取私利的行为,监控公权力防止其滥用是治理腐败的根本措施。法治的核心任务是依法治权,法治的重要内容是依法监控权力。因此,从某种意义上说,反腐败与治权是同一命题的两个方面,反腐治权也成为法治社会治理腐败的共同选择。反腐治权是我国当前"夺取反腐败斗争压倒性胜利"的根本之策,也是法治中国的题中之义和全面推进依法治国基本方略的应有举措。以法治思维和法治方式开展反腐败斗争是反腐治权的基本路径,这主要源于权力腐败的成因。权力腐败形成的因素诸多,但法治缺失是根本原因。运用法治思维和法治方式反腐败,就是要通过宪法和法律科学配置权力、权力运行要遵守宪法和法律、权力滥用者责任追究要依法进行。
