摘要
"天人不相预"的唯物论、重"势"的进步历史观、"官为民役,民可黜官"的民本思想、儒家的法治精神等是柳宗元法治思想形成的理论基础。柳宗元法治思想主要体现在"德礼刑政"的统一观、"赏罚必当"的判案观、"赏罚务速"的执法观、"贤者居上"的保障观等方面,其法治思想在当今司法实践中仍然具有深刻的启示价值。
The theoretical basis of Liu Zongyuan's thoughts of rule by law includes: no interaction between human being and nature,conforming to historical trends, serving the people, and the legal spirits of Confucianism. And this thoughts are Mainly embodied in the unity of morality and criminal law, poetic justice, effective enforcement of law, the reign of virtuous and talented people. Liu Zongyuan'sthoughts still has a very positive and practical significance today.
