摘要
不可否认,小产权房的出现及发展已是大势所趋,其不仅反映了城乡一体化的要求,也反映了农民对提高土地征收收益及居民对完善住房保障体系的愿望。本文通过对小产权房概念以及我国小产权房现状的深刻剖析,揭示了小产权房问题的产生原因,在法律途径、城乡二元体制、住房保障体系等方面构建出适合我国实际的小产权房合法化解决机制。
There is no denying that the trend of limited property rights is irreversible,it not only reflect the need of urban and rural integration but also show the aspiration of increasing the land expropristion and improve the housing security system.This article will firstly study the reasons and current sismation of the problemsofthe small property house and then,will propose legal avenuses,urban-rural dual structure,housing security system so as to built up problem solving mechanism that suitable for the practical small property houses in China.
