“马工程”《国际金融法》的实践、制度及理论依据初探

A Tentative Exploration of the Practice, System and Theoretical Base of “The International Finance Law”

在《国际经济法》主要组成部分——国际金融法基本制度的基础上,以马克思主义的集体主义价值目标为标准,通过分析现有的国际金融法律制度属性与本质特征,发现从金融法领域的《WTO服务贸易总协定》《巴塞尔协议》《国际货币基金组织协定》等制度中都可以挖掘出具有社会主义属性的制度因素。人类公共利益需求是进行金融监管的客观基础,人类社会是市场和政府不可或缺的综合体的客观现实表明,理论上应该形成市场无形之手与政府有形之手契合的国际金融法,构建公法与私法相结合的、完整的国际金融法律体系。这揭示了中国特色社会主义市场经济理论具有国际金融法律制度客观存在的制度依据及现实基础,为全球化背景下国际经济法及社会主义理论的研究打开了一个新视角,为我国社会主义市场经济理论国际化奠定了理论与制度基础,展现了"马工程"《国际经济法》教材和教学建设的必要性、科学性及可行性。

Socialist nature can be found from these systems like ＂General Agreement on Trade in WTO Service＂, ＂Basel Accord＂ and ＂Agreement of the international Monetary Fund.＂ After the natural feature of international law system is analyzed on the basis of Marxism collectivism. Human＇ s requirement for public interests is the base of financial supervision and the society is an indispensible com- plex of market and government. And this fact indicates that the international finance law is supposed to be a systematic law involving the supervision of market and government as well as the agreement between public law and private law. This also reveals that the socialist market economy with Chinese characteristics is possessed of the base and evidence allowed for the international finance law system, offering a new perspective of looking at international economic law and socialism theory, which can lay theoretical foundation for the internalization of Chinese socialist market economy.And this can show that developing the textbook ＂The International Economic Law＂ is necessary, scientific and feasible.
