Understanding Criminal Law Dogmatics in Contemporary China

刑法教义学的发展,是当代中国刑法知识转型的重要标志。理解当代中国刑法教义学,既要从法教义学的普遍立场和一般方法论出发,也要充分认识中国刑法理论发展的历史和现实。刑法教义学的引入不意味着学术主体性的丧失,应当区分法教义学知识与法教义学方法。要仔细甄别域外教义学知识与中国刑法语境的兼容性,积极引入没有语境障碍的教义学知识,并运用教义学的一般方法创造立足本土的新教义。中国刑法教义学发展的当务之急是加强体系性,同时对未来可能出现的体系封闭和僵化保持警惕。社科法学的研究不会对法教义学形成挑战,而是提供了资源和助力。法教义学有能力回应和解决疑难案件,在广泛吸收多学科知识并充分考虑利益、价值等因素的同时,仍然保持法律场域中法教义学论证的独特性。法典化国家的历史现实,决定了法教义学是法学研究的主流范式,但绝非法学研究的全部;法教义学应当充分尊重其他法学研究方法,虚心学习、共同繁荣。

The evolution of Criminal Legal Dogmatics epitomizes the transformation of criminal law in contemporary China. To understand Chinese Criminal Legal Dogmatics, based on the universal principles and general methods of Legal Dogmatics, it should also be recognized the development of Chinese crimi- nal law theory from the past and present perspectives. Introducing Criminal Legal Dogmatics will not marginalize the academic independence, considering the difference between Legal Dogma and Legal Dog- matic Methodology. It is imperative to examine the compatibility of foreign legal doctrines and Chinese criminal law, and introduce the legal doctrines without contextual barriers, and thus establish the adap- ted Legal Dogma through the general methods of Legal Dogmatics. In contemporary China, systemization is the urgent priory for the development of Criminal Legal Dogmatics. Meanwhile, it should be acknowl- edged the potential isolation and ossification of the system. The research of Law and Social Sciences tends to reinforce, rather than challenge, Legal Dogmatics. Incorporating interdisciplinary knowledge and bal- ancing the interests and values, Legal Dogmatics is capable of solving tricky cases while retaining its rea- soning characteristics. It is true that Legal Dogmatics is the mainstream paradigm of legal research. How- ever, Legal Dogmatics cannot represent the whore picture of legal research. Legal Dogmatics should re- spect and learn from other legal research methods, and therefore achieve mutual prosperity.
