知识产权制度作为赋予权利人的垄断性权利,在权利人专有控制前提下必然增加智力资源的获取成本。过度的权利主张导致资源获取的交易成本上升,阻碍后续的创造行为。从社会整体角度看,知识产权权利主体的数量越多则智力资源在宏观层面的获取成本越高且难度越大。为了解决这个潜在问题,公共领域的维持和发展就有其必要的意义。

Intellectual property regime grants right owners statutory monopoly, whereby the costs of access intellectual sources increase signifi cantly due to the exclusive right enjoyed by IP right owners. Excessive claims lead to high-stake costs of access, blocking the derivative creation later on. In the perspective of the society as a whole, the more claimants the more complicated to internalize costs of access. To resolve the problem, it is necessary to maintain and develop the public domain.
