网络虚拟财产继承的法律问题研究

网络虚拟继承近年来一直是讨论的热点话题,随着《民法总则》对网络虚拟财产的规定,对于解决网络虚拟财产继承问题提供了法律基础。从《民法总则(草案)》的说明中确定网络虚拟财产的法律性质,借鉴国外的立法经验,分析我国目前网络虚拟财产继承的状况和问题,对网络虚拟财产的归属、网络用户协议与隐私保护对网络虚拟财产继承的影响以及网络遗产托管业务进行梳理。立法上,将网络虚拟财产纳入到《继承法》中是可行之举,并对继承的主体、客体、程序、无人继承遗产的处理作出具体规定。

The ＂General Principles of Civil Law＂ on the provisions of the network of virtual property providesa legal basis for themanagement of virtual property inheritance network. This paper analyzes the legal nature of the network virtual property from theexplanation of the General Principles of Civil Law, draws lessons from the experience of foreign legislation, analyzes the currentsituation of the network virtual property in our country, the attribution of the network virtual property, the network useragreement and the privacy protection to the network virtual property inheritance and the network heritage hosting business.Legislation of the network of virtual property into the ＂succession law＂is feasible.
