我国民事诉讼高度盖然性证明标准分析及具体适用

The Analysis and the Application of Civil High Probability Standard

据《最高人民法院关于民事诉讼证据的若干规定》以及《民诉法解释》的规定,确定我国民事诉讼证明标准为高度盖然性,但是在司法实践中高度盖然性标准出现概念不清、使用不规范、与英美法系的"优势证据"相混淆以及实际操作困难的问题。高度盖然性标准应当进行统一的规范指导,通过对国内现状的分析以及域外规定的借鉴,确定其影响因素,同时制定一套多层次的标准规范。

According to the Provisions of the Supreme People＇s Court on the Provisions of the Evidence of Civil Litigation and the Interpretation of Civil Procedure Law, the standard of civil litigation in China is high probability. However, in the judicial practice, the high probability standard has some problems, such as the unclear concepts, the substandard use, the confusion of advantage evidence of the Anglo-American law system and the problem of difficult practical operation. Therefore, high probability criteria should be guided by a unified specification; and after determining its influencing factors, by analyzing the present domestic situation along with foreign rules for reference, a multi-level standard specification shall be developed in the end.
