医疗损害赔偿纠纷中的专家出庭制度研究

Study on Expert Court System in Medical Damage Compensation Dispute

本文考察了我国医疗损害赔偿纠纷中专家出庭现状,认为其存在着鉴定专家意见的证据能力不足、专家的资格判定参差不齐、鉴定费用较高等缺陷,由此提出从专家的诉讼地位、效力判定、费用承担、出庭保护等方面来完善专家出庭制度的建议。

This paper explores the current situation of expert court system in compensation dispute of medical damages in China, argues that there exist the defects such as the inadequate proof capacity of experts＇ opinions, mixed qualifications of the experts, high appraisal cost, etc.,and puts forward suggestions to improve expert court system from the perspectives of expert＇s litigation status, effectiveness of judicial review,cost paying, and court protection, etc.
