摘要
文章据两个典型案例予以比较分析,对医疗事故技术鉴定意见司法审查的必要性和一般方法论进行了探讨,认为法官应充分发挥司法的认知能力,以证据学原理、相关法律规定和医学理论为依据,对鉴定意见进行客观、科学的审查。
This paper, taking two typical cases as material, using comparative analysis method, discusses the ne- cessity and genenal methodology of judicial review on technical appraisal of medical accidents,and argues that the judge should give full play to the judicial cognition, with evidence theory, related laws and regulations, and medical theory as the basis, review on experts opinions objectively and scientifically.
